Regulations governing artificial intelligence (AI) have taken a significant step forward with the introduction of the AI Act, which was adopted on 21 May 2024 by the Council of the 27 member states of the European Union. Despite being deemed an important advancement in the realm of AI governance, experts assert that the legislation contains several flaws that necessitate further discussion and refinement.
The AI Act is designed as a comprehensive framework aimed at fostering a European single market for AI, while prioritising human-centric and trustworthy applications of this emerging technology. Its primary objectives encompass safeguarding health, ensuring safety, and protecting fundamental rights as articulated in the Charter, which includes promoting democracy and the rule of law, while addressing environmental concerns associated with AI systems.
The scope of the AI Act is broad, applying to AI systems marketed in the EU regardless of the origin of the providers, making it relevant even for companies based outside the Union, including those from Australia. This aspect of the Act raises questions about its global impact, especially as an initial proposal to impose an export ban on certain AI systems was rejected during the legislative discussions.
Although the AI Act is hailed as the first legally binding regulatory framework for AI worldwide, concerns have been raised over its effectiveness. Dr Hannah Ruschemeier, a junior professor of public law and data protection law at the University of Hagen in Germany, highlights that the Act merges two fundamentally different regulatory approaches: product safety law and the protection of fundamental rights. This amalgamation could risk undermining the legislative intent.
The Act categorizes AI systems based on the risk they pose, establishing five risk categories: unacceptable risk, high risk, minimal risk, no risk, and systemic risks associated with general-purpose AI systems. However, critics argue that this tiered approach may not sufficiently capture the complexity of AI's societal impacts. For instance, systems with high-risk classifications can still legitimise the use of controversial technologies—like polygraphs and emotional recognition systems—despite their dubious effectiveness and empirical validation.
Furthermore, certain areas that require stringent oversight, such as algorithms used in media, academia, finance, and specific insurance sectors, are reportedly ignored within the current framework. The risk categories and provisions surrounding high-risk systems may inadvertently normalise their usage without addressing potential violations of fundamental rights and democratic processes.
Dr Ruschemeier asserts that regulating AI is inherently about balancing power dynamics tied to data usage and societal implications. She emphasises the necessity for ongoing dialogue in democratic forums regarding AI regulations, rather than allowing legislative frameworks to be dictated purely by technological advancements.
In summary, while the AI Act represents a foundational step toward regulating AI in the EU, the challenges it faces—including its classifications of risk, effectiveness in protecting fundamental rights, and its overall oversight mechanisms—suggest that further refinement and discussion are imperative to address the evolving landscape of data-driven technologies.
