The evolving landscape of artificial intelligence and its impact on political discourse has prompted numerous state legislatures in the United States to address concerns regarding deepfake technology in the context of election integrity. Deepfakes, defined as hyper-realistic audio or video content generated by AI that may misrepresent public figures, have raised significant alarm as they have become tools for misinformation during political campaigns.
The legal ramifications surrounding deepfake technology first surfaced prominently in 2017, following the emergence of an anonymous deepfake video of California Congresswoman Nancy Pelosi that depicted her as inebriated. In response, California and Texas implemented laws prohibiting the creation and dissemination of deepfakes in proximity to elections. California's Assembly Bill 730 provides an allowance for manipulated media, provided it is distinctly marked as fake or parody, while Texas escalated its approach by criminalising deepfakes disseminated within 30 days of an election as a Class A misdemeanor.
In the subsequent years, this regulatory trend expanded, leading to a total of 20 states adopting similar legislation by the close of 2024. Notably, as of early 2024, less than 200 instances of political deepfakes had been recorded, underscoring the nascent state of legal enforcement regarding these technologies. However, California’s new laws targeting deepfakes in 2024 received substantial attention following a controversial manipulated campaign video involving Vice President Kamala Harris. In signing the “Defending Democracy from Deepfake Deception Act of 2024,” Governor Gavin Newsom highlighted the significance of these regulations in the face of misinformation.
The legislation comprises three primary components: AB-2655 mandates social media platforms to label or block deepfakes that could mislead voters; AB-2839 holds the creators and reposters of such deceptive content legally accountable; and AB-2355 requires clear disclosures labelling manipulated media. However, legal scrutiny swiftly followed, as creator Christopher Kohls filed a lawsuit challenging the constitutionality of AB-2839. U.S. District Senior Judge John Mendez ruled that while certain aspects of the law were permissible—namely disclaimers—many provisions served as an unconstitutional restriction on free speech.
In Minnesota, a similar legal battle unfolded regarding its own deepfake legislation, which introduced extensive measures for preventing the dissemination of deceptive media during elections. The case gained notoriety when it was revealed that the expert testimony submitted by Stanford University professor Jeff Hancock included misinformation generated by AI, raising questions about the reliability of information presented in court. Attorney Frank Bednarz noted that rather than pursuing censorship, the best defence against falsehoods remains accurate expression, further complicating the debate on regulating deepfakes in political contexts.
As the technological landscape advances and the ramifications of AI-generated content continue to unfold, these legal confrontations are expected to increase. Elon Musk’s X, formerly Twitter, has also sought to challenge California's new laws, suggesting that the tensions between regulatory measures and free speech rights will endure. Despite the apprehensions surrounding AI-generated content, legal experts highlight that many deceptive acts can already be addressed through existing frameworks related to copyright and privacy rights.
