Amazon’s Partnership with Anthropic Clears UK Competition Regulator's Scrutiny

The Competition and Markets Authority (CMA), the UK’s competition watchdog, has decided not to pursue further investigation into the partnership between Amazon and artificial intelligence firm Anthropic. The decision comes after an initial Phase 1 investigation, which probed whether Amazon’s significant $4 billion investment in Anthropic and their other arrangements constituted a merger situation that might negatively impact competition within the AI sector.

The CMA, renowned for its vigilant stance over potential monopolistic trends among tech giants, conducted an in-depth review of the partnership. The authority's investigation assessed Amazon's arrangements with Anthropic against established benchmarks for turnover and share of supply. These criteria are fundamental in determining whether the partnership could potentially hinder competitive practices within the market.

Joel Bamford, the executive director of mergers at the CMA, elucidated the findings in a LinkedIn post. He stated, “Reviews like this help us to gain more clarity around whether they could fall under UK merger rules and any subsequent impact they could have on competition. We hope that this clarity also benefits businesses with an interest in these markets.”

The investigation revealed that Amazon’s investment and the associated rights did not meet the necessary thresholds for turnover and share of supply. Consequently, the CMA concluded that the arrangements did not enable Amazon to exercise material influence over Anthropic that could stifle competition. Therefore, there was no sufficient basis to escalate the probe to a Phase 2 investigation.

The CMA remains wary of the extensive investments and partnerships between major technology firms and AI start-ups, which it terms as an "interconnected web" capable of consolidating power and resources within the sector. This environment raised alarms earlier this year, leading to the watchdog's scrutiny of over 90 strategic investments and partnerships among the industry's leading players.

Despite clearing the Amazon-Anthropic deal, the CMA continues to scrutinise other relationships within the AI industry. Ongoing investigations include analyses of partnerships between Google and Anthropic, as well as between Microsoft and OpenAI, the creators of ChatGPT.

This decision marks a notable stance by the CMA concerning the regulatory oversight of the emerging AI industry, suggesting that despite significant investments, not all tech alliances pose a competitive threat under existing UK merger rules.
